BOARD OF APPEALS
OCTOBER 24, 2005 4:00 P.M. VILLAGE HALL
1. ROLL CALL was answered by Acting Chairman Rosalie Gellman and Members Melnick, Spector and Alternate Member Smith. Acting Chairman Gellman confirmed that a quorum of four members had been met.
2. THE AGENDA: Motion by Spector, Melnick second to approve the agenda as published and posted. Motion carried unanimously.
3. THE APPEAL OF MR. & MRS. DONALD BOBBS REGARDING THE BUILDING INSPECTOR’S DENIAL OF A BUILDING PERMIT FOR A SINGLE FAMILY RESIDENCE AND ATTACHED 4.5-STALL GARAGE AT 8110 NORTH RIVER ROAD BECAUSE THE PROPOSED RESIDENCE VIOLATES SECTION 7.0205(b) OF THE GENERAL ORDINANCES OF THE VILLAGE OF RIVER HILLS WHICH ALLOWS FOR ONLY ONE PRINCIPAL STRUCTURE PER LOT: Tony Enea, Ruvin Brothers, represented the owner. He informed the Board that the new residence would be built south of the existing house and that part of the existing garage would be razed to allow construction to begin. The family wanted to remain in the existing house so their children would not be interrupted in their schooling. After discussion, a motion by Melnick, Smith second to approve the variance to allow the existing house to remain while the new house is under construction with the stipulation that the existing house be razed within 90 days after a temporary occupancy permit has been issued. Mr. Melnick stated there had been ample precedence set to allow these types of variances, that the granting of the variance allows a use that is consistent with the existing zoning, that the variance is not based on economic reasons and the granting of the variance will not create a detriment to adjacent property nor materially impair or be contrary to the zoning ordinance or be contrary to the public interest. He welcomed the addition of this new home to the community and reiterated the practical difficulty, hardship and inconvenience that would be created by not granting the variance. Motion carried unanimously.
4. Motion by Melnick, Spector second to adjourn the meeting at 4:07 p.m. Motion carried unanimously.
