BOARD OF APPEALS

 

 

NOVEMBER 30, 2005       4:30 P.M. VILLAGE HALL

 

 

 

1.                  ROLL CALL was answered by Chairman James Plunkett and Members Melnick, Spector, Cramer, and Alternate Member Smith.

 

2.                  THE AGENDA:  Motion by Spector, Melnick second to approve the agenda as published and posted.  Motion carried unanimously.  

 

3.            THE APPEAL OF LARRY BOYER REGARDING THE BUILDING INSPECTOR=S DENIAL OF A BUILDING PERMIT FOR A GARAGE ADDITION AT 9365 NORTH PHEASANT LANE, RIVER HILLS, WISCONSIN, BECAUSE THE ADDITION WOULD EXTEND A NON-CONFORMING STRUCTURE WHICH WOULD BE IN VIOLATION OF SECTION 7.0703(A) OF THE VILLAGE OF RIVER HILLS ORDINANCES:  Mr. Boyer and his wife presented their plans to the Board for a 25’x32’ addition to the two-car detached garage located on their 1.09- acre property.  Since the northerly half of his lot has a ravine, he pointed out that the only reasonable place for the addition is to the south of the existing garage.  He stated that the existing garage is well built and that he planned on adding dormers to the old and new parts of the garage to match those on the house.  The present garage is 14.5’ from the rear lot line which causes the garage to be a non-conforming structure.  The variance requested will allow the addition to continue along the 14.5’ setback.  He believed the design of the garage was sensitive to the character of the Village and would not conflict with other homes in the area.  Motion by Melnick, Spector second to approve the request for a variance due to the findings that there would be no detriment to the adjacent property in that there would be limited additional encroachment to the set back line, that granting a variance was consistent with the intent of the zoning ordinance, and that failure to grant the variance would impose an unnecessary hardship and that the position of the residence and garage on the lot presented a unique property limitation.  Motion carried unanimously.

 

4.           ADJOURNMENT:  Motion by Smith, Melnick second to adjourn the meeting at 4:47 p.m.  Motion carried unanimously.
